Licence terms

01What you are buying

You are buying a licence to use ARP Admin Panel ("the Software"), not the Software itself. All copyright, source code and other intellectual property remain with Brent Kemps ("we", "us").

The licence is non-exclusive, non-transferable and granted to you alone.

02One licence, one server

Each licence key may be used on one FiveM server at a time.

The key binds to the first server that uses it. If you move to a different server or reinstall your host, contact us at Alkmaar.Creator.Info@gmail.com and we will release the binding. Do not buy a second licence for a server move.

Running one key on several servers at the same time is not possible and is a breach of these terms.

03What you may not do

You may not:

• resell, re-license, rent, lend, share, publish or otherwise distribute the Software or any part of it, paid or free, modified or unmodified;
• share your licence key, or give any third party access to the Software other than the staff of your own server;
• decompile, disassemble, deobfuscate, decrypt, extract or otherwise attempt to recover source code or assets from any protected part of the Software;
• circumvent, disable, patch or interfere with the licence checks, the code signing, the escrow protection or any other protection mechanism;
• remove, alter or obscure any copyright notice, licence notice or identification marker contained in the Software;
• use the Software to build, train or assist a competing or derivative product.

You may edit the configuration files that we ship unprotected for that purpose, and use the Software on your own server for its intended purpose.

04Delivered copies are traceable

Each delivered copy of the Software carries markers that identify the licence it was issued to. If a copy appears anywhere it should not, we can determine which licence it came from.

We log each delivery of the Software to a server, including the time, the licence used and the requesting IP address.

05The Software needs our online service

The Software connects to our hosted service to validate your licence, to receive its server-side components and to serve the web panel. It does not function without that connection.

We will make reasonable efforts to keep the service available but do not guarantee uninterrupted availability. Planned maintenance will be announced where practical.

If we permanently discontinue the service, we will give at least 30 days notice where reasonably possible.

06Suspension and revocation

We may suspend or revoke a licence if:

• these terms are breached;
• the purchase is refunded, charged back or disputed;
• the licence was obtained fraudulently.

A revoked licence stops working. Revocation for breach does not entitle you to a refund.

07Refunds

Because the Software is delivered digitally and immediately, purchases are final once the licence key has been issued and used. If the Software does not work on a supported setup and we cannot resolve it within 30 days, contact us at Alkmaar.Creator.Info@gmail.com and we will refund you.

Chargebacks filed without contacting us first will result in revocation.

08No warranty, limited liability

The Software is provided "as is". We do not warrant that it is free of defects or fit for any particular purpose.

To the fullest extent permitted by law, our total liability arising from the Software or these terms is limited to the amount you paid for the licence. We are not liable for lost revenue, lost data, downtime, player loss or any indirect or consequential damage.

Nothing in these terms excludes liability that cannot be excluded by law, including your statutory rights as a consumer.

09Your server's data

The Software processes data from your server, including player identifiers, in-game actions and moderation records, and stores some of it on our service so your panel can work.

For the data of your own players you are the controller and we act on your instructions as processor. You are responsible for informing your players as your local law requires. Contact Alkmaar.Creator.Info@gmail.com for a data processing agreement if you need one.

10Support and updates

Support and updates are provided for the Software while your licence is active, through our Discord. We may change or discontinue individual features between versions.

11Changes to these terms

We may update these terms for future purchases. The terms you accepted at checkout apply to your purchase.

12Law and jurisdiction

These terms are governed by the law of Belgium. Disputes are subject to the courts of Limbourg, without prejudice to any mandatory consumer protection in your country of residence.
